1. Agreement to Terms
By accessing or using HygieneLog ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.
These Terms apply to all users of the Service, including visitors, registered users, and organisations. Your use of the Service is also governed by our Privacy Policy.
2. Description of Service
HygieneLog is a digital hygiene compliance logging platform that enables businesses to create checklists, capture evidence (photos, signatures), track compliance activities, and generate audit-ready reports. The Service is provided as a software-as-a-service (SaaS) platform accessible via web browsers and mobile devices.
3. Account Registration and Security
3.1 Registration
To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Account Security
- You must notify us immediately of any unauthorised use of your account
- You are responsible for ensuring your password is strong and kept secure
- You may not share your account credentials with others
- We reserve the right to suspend or terminate accounts that violate these Terms
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Upload, transmit, or store malicious code, viruses, or harmful software
- Attempt to gain unauthorised access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Impersonate any person or entity or misrepresent your affiliation
- Upload content that infringes intellectual property rights or privacy rights
- Use the Service to store or process sensitive personal data without proper consent
5. Subscription and Billing
5.1 Subscription Plans
HygieneLog offers various subscription plans with different features and limits. Subscription fees are billed in advance on a monthly or annual basis, as selected during registration.
5.2 Free Trial
We offer a 30-day free trial period. At the end of the trial, you will be automatically charged unless you cancel before the trial expires.
5.3 Payment
- Payments are processed securely through Stripe
- All fees are non-refundable except as required by law or as explicitly stated
- We reserve the right to change pricing with 30 days' notice
- Failed payments may result in Service suspension
5.4 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.
6. Intellectual Property
6.1 Our Rights
The Service, including its design, features, functionality, and content, is owned by HygieneLog and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
6.2 Your Content
You retain ownership of all data, content, and materials you upload to the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service.
7. Data Protection and Privacy
We handle your data in accordance with our Privacy Policy and applicable data protection laws, including GDPR. You are responsible for ensuring that any personal data you upload complies with applicable privacy laws and that you have obtained necessary consents.
8. Service Availability and Modifications
We strive to maintain high availability but do not guarantee uninterrupted or error-free service. We reserve the right to:
- Modify, suspend, or discontinue features at any time
- Perform scheduled maintenance with reasonable notice
- Make changes to improve security, performance, or compliance
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in the 12 months preceding the claim
- We are not responsible for compliance decisions made based on Service data
Nothing in these Terms excludes or limits liability for death, personal injury, fraud, or other matters that cannot be excluded by law.
10. Indemnification
You agree to indemnify and hold harmless HygieneLog, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your Content or any infringement of third-party rights
- Your violation of any applicable laws or regulations
11. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination:
- Your right to use the Service ceases immediately
- We may delete your account and data after a reasonable retention period
- You may export your data before termination (subject to plan limitations)
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
